Lawsuit dismissed against Calgary MP
Anders legal spat with office manager resolved

MP Rob Anders and his former office manager have apparently resolved their legal spat.

An order dismissing the lawsuit filed by James Istvanffy and a countersuit by Anders has been granted by a Calgary judge, effectively ending the dispute.

The order, a copy of which was obtained on Friday by the Sun, states neither side will bear a financial burden.

“The ... actions of the plaintiff, James Istvanffy, and the plaintiff by counterclaim, Rob Anders, are dismissed by the consent of the parties without costs,” it says.

But despite the apparent resolution, Anders’ lawyer, Rick Gilborn, said he could not yet comment on the dismissal order.

Istvanffy lawyer Gulu Punia could not be reached.

Istvanffy sued Anders in May, alleging the Calgary West MP misused House of Common expenses.

It also claimed some of Anders’ staff, paid by taxpayers, worked on an “unspecified” campaign for Prime Minister Stephen Harper.

Istvanffy said he was wrongfully fired by Anders and claimed damages of $51,500 for lost wages and other non-specific amounts for outstanding loans.

It said Istvanffy often lent money to Anders to cover expenses which the House of Commons would not cover.

But Anders, in his defence and counterclaim, said if any monies were mismanaged it was by Istvanffy’s overseeing of the Tory’s operating budget as a Member of Parliament.

It also denied any claims of misuse of taxpayer funds calling the allegations an “obvious attempt to politically attack (Anders).”

Anders sought damages of $25,000 for Istvanffy’s handling of his budget and his statement of defence said he would seek full legal costs from the court.

Istvanffy had filed a notice to strike Anders counterclaim.

A hearing was scheduled for July 26, to hear his application, but was adjourned without a new date being set.

The initial lawsuit led to calls by opposition MPs for an RCMP investigation into the allegations of misusing public money.
