Suit alleges botched birth

CALGARY (Sun Media) - Rockyview Hospital doctors botched a breach birth leaving a Nanton toddler with countless medical problems, a multi-million dollar lawsuit claims. A statement of claim filed on behalf of little Kaitlyn Baumgartner and her mother, Shanna, alleges doctors didn't discover soon enough the child wasn't in the correct birthing position. Had they done so, Kaitlyn could have been moved inside her mom's womb to be delivered head down, or a caesarian section should have been performed, the claim states. The court action, a copy of which was obtained by the Sun, seeks $3,275,000 for Kaitlyn, who turns two on Sunday, and $600,000 for her mother. Because the girl was born during an emergency breach delivery, she suffered a litany of injuries, including a condition where her neck turns to one side. The toddler also suffered auditory, visual and speech impairment along with developmental delays as a result of the negligence, the claim alleges. The lawsuit names nine different doctors along with the Calgary Health Region as defendants. Statements of defence disputing the unproven allegations have not yet been filed. |
