A Winnipeg man who sexually assaulted a woman after hearing her having sex with her boyfriend has been sentenced to 30 months in prison.
Robin Spence pleaded guilty to sexual assault nearly four years ago but repeatedly skipped court and disappeared until his arrest at a Logan Avenue apartment last May.
Justice Brenda Keyser credited him nine months for time served, reducing his remaining sentence to 21 months.
In a pre-sentence report, a probation officer who interviewed Spence following his arrest said he "was talking delusionally that every woman wants him."
Spence visited the victim, an acquaintance, at her Laura Street apartment in June 2003 on the pretence of selling her a camera lens. Spence said he heard the victim having sex with her boyfriend and "wanted some."
When the woman rebuffed his advances he followed her into her bedroom and sexually assaulted her.
The Crown sought a three-year prison sentence, while the defence asked Keyser to consider a conditional sentence of two years less a day.
Defence lawyer Kathy Bueti told court last month Spence was high on cocaine when he called on the victim, who, according to Spence, answered the door in the nude.
"He did not go to the suite that night for sexual relations," Bueti said. "He was not thinking this was how the night was going to end."
Keyser noted Spence has made no effort to address his drug addiction while in custody. She ordered his name be listed on the national sex offender registry for 20 years.
