Man jailed for goading pal to shoot rival

One of a pack of teens who goaded a friend to shoot a rival gang member has been sentenced to one year in jail.

The 18-year-old cannot be named because he was a youth at the time of the September 2007 shooting.

The accused, several other youths and the alleged shooter Terry St. Germaine -- all members of the same street gang -- were walking in the area of Wellington Avenue and Victor Street when they came upon a group of rival gang members and a verbal confrontation ensued.

St. Germaine allegedly pulled a sawed-off shotgun from his pants as the accused and two other youths yelled "Shoot him, shoot him," and "If you don't shoot him I will," Crown attorney Susan Baragar told court last week.

A male youth 20 metres away was hit at the base of his skull. He has since recovered from his injuries.

"This is very clearly the type of action that in all likelihood would never have happened but for the group behaviour of all of them inciting (the shooter) to pull out the gun and shoot," Baragar said.

At the time of the shooting the accused had just begun a sentence of two years probation for a series of property offences. "The probation order was barely dry," Baragar said.

Subsequent to the shooting but prior to his arrest, the teen and another shooting accused were arrested after beating a man to the brink of death. He served a four-month sentence for that offence while awaiting sentencing for the shooting.

Two other youths have received sentences of one year and two years for the shooting. St. Germaine remains before the courts.
