CALGARY - The 12-year-old girl who had sexual intercourse with a boy near a Calgary schoolyard was stumbling drunk at the time.
In an agreed statement of facts made an exhibit in court Wednesday, it was revealed the pre-teen consumed most of a 26-ounce bottle of vodka as well as other booze.
The 16-year-old male pleaded guilty to sexual assault in youth court, along with two breaches of his release conditions, in the Sept. 6 assault at a baseball diamond behind a school.
The court exhibit, entered by Crown prosecutor Jenny Rees and signed by the teen and his lawyer, Tonii Roulston, said the pair met on the social networking site Nexopia a week earlier.
They agreed to meet in the field behind the northeast school and the girl told Roulston's client she wanted to be his "bed buddy."
The girl consumed two coolers and other hard liquor before she and a friend met the teen at the park, before leaving to pick up some more friends and booze.
After one arranged for a friend to buy two bottles of liquor, they returned to the park area "where (the girl) was seen falling asleep.
"She did wake up twice to consume a large quantity of liquor from the bottle of vodka purchased from the store," the court exhibit said.
"(The victim) consumed most of the 26-ounce bottle of vodka."
The girl then indicated she wanted to have sex with the teen, making the others feel uncomfortable and move away from the bleachers where the pair were seated.
"(The girl) was obviously heavily impaired by alcohol and was observed stumbling off the bleachers and lying down on the grass," the statement of facts said.
The victim removed the pyjama bottoms she was wearing and the teen had protected sexual intercourse with her.
The girl, who was too young to consent, later said she had no recollection of the sexual contact.
"The sexual assault was witnessed by two staff at Clarence Sansom school," the exhibit said.
"One of the staff members videotaped the group in the aftermath, but did not capture the sexual assault on tape."
At counsels' request, Judge Judith Shrier ordered a pre-disposition report as well as a psychiatric and risk assessment.
Sentencing was set for June 2.
