Voyeur spared jail time

OTTAWA — A man who covertly taped himself having sex with his then-girlfriend was spared jail Tuesday.

Robert Bentham, 26, received a suspended sentence and 12 months of probation after pleading guilty in May to mischief, assault and voyeurism.

The Crown had asked for a 15- to 30-day jail sentence and 18 months of probation.

The woman learned of the sex tape before they broke up — at first she just asked him for a copy. The court heard he had never tried to distribute the tape.

Bentham had also admitted to slapping the woman and breaking her car's windshield.

He became depressed and lost his job after the charges were laid, but Bentham is now flourishing with new work and strong support, the court heard.

Bentham was ordered not to communicate with the woman.
