Daycare worker dodges jail after boiling baby's feet

MONTREAL — A former daycare worker avoided jail after scalding a toddler's feet for what she claimed was toilet training.

A judge allowed Carolyne Gagne to go free despite the Crown's recommendation that she serve 18 months in prison for torturing the child at a home daycare in 2010.

Gagne, 28, had pleaded guilty to criminal negligence causing bodily harm against a two-and-a-half year-old boy.

During a sentencing hearing Tuesday at the Montreal courthouse, judge Salvatore Mascia acknowledged "the crime is serious, the victim vulnerable."

He also noted the boy suffered permanent injuries.
