TORONTO - A mistrial was declared Saturday in the case of a babysitter accused of killing his girlfriend’s infant son.

Ronny Munoz-Hernandez was accused of second-degree murder in the Nov. 9, 2010, death of Adriel Garcia.

Justice Nola Garton declared the mistrial after the jury sent its second note in two days of deliberations, saying it had reached an impasse and couldn’t reach an unanimous verdict.

The prosecution alleged the 25-year-old man inflicted the fatal head injuries on his girlfriend Jessica Da Silva’s son while babysitting him on Sept. 11, 2010 as she attended a wedding.

Crown attorneys Laura Bird and Alex Rourke alleged that Da Silva left Munoz-Hernandez with a healthy baby and the next day the five-month-old boy was battling for his life, undergoing emergency brain surgery. But he ultimately died in his mom’s arms almost two months later.
