Mike Mooney died after a cottage he was helping raise collapsed on top of him.

On Tuesday, Ray Harms, the contractor who employed Mooney, was fined nearly $94,000 after pleading guilty to one count of failing to ensure the safety, health and welfare of his workers.

"There was nothing in place for someone underneath the cottage to be protected," Crown attorney Tim Chudy told Judge Tracey Lord of the June 20, 2011 incident. "There was no safeguard. That was something that was never contemplated."

Court heard the Victoria Beach cottage had been raised 22 inches above its prior height when without warning it collapsed.

"Just boom, it went down," Chudy quoted a witness as saying. Harms, his two sons and Mooney -- a 23-year-old carpentry apprentice -- were all underneath the cottage when it collapsed. Harms and his sons escaped injury while Mooney was pinned under the cottage's south wall.

Mooney was pronounced dead in hospital an hour later.
