A Florida man planned to celebrate his acquittal for killing his wife's lover by taking his cheating spouse to the Waffle House.

Retired U.S. Army Lt. Col. Ralph Wald, 70, caught his wife Johnna Lynn Flores, 41, having sex with with a man on the living room floor about midnight March 10.

Wald went to his bedroom, grabbed a .38-calibre revolver and shot Walter Conley, 32, in the head and stomach, the Tampa Bay Times reported.

It was unsuccessfully argued by prosecutors that Wald, who has erectile dysfunction, became enraged seeing his drunk wife making out with another man and killed him out of jealously, the Times reported.

Wald's lawyer said his Vietnam War vet client thought Conley, a former boyfriend of Flores, was an intruder who was raping his wife.

The defence used the state's "stand your ground" self-defence law to argue for acquittal, according to the Times.

After two hours of deliberations, the jury set Wald free.

"I am elated, absolutely elated,"the Times reported an ecstatic Flores said outside a Tampa Bay courthouse following the verdict, adding the couple had planned a special celebration.

"Because my husband puts me first, he's taking me to the Waffle House."
